Seller and scope<\/h2><p>These General Terms and Conditions of Sale govern sales of standard physical products from the SimuGolf catalogue to consumers on simugolf.fr. The seller is ARNOLI, a French single-member simplified joint-stock company (SASU) with share capital of \u20ac1,000, whose registered office is at 7 rue Condorcet, 91350 Grigny, France, registered with the \u00c9vry Trade and Companies Register under number 922 167 044. Intra-community VAT number: FR34922167044. Contact: contact@simugolf.fr; telephone: +33 9 71 31 73 23. SimuGolf is a SimuSports brand operated by ARNOLI. The applicable terms are those presented and accepted when the order is placed. Sales to business customers require separate terms.<\/p><\/section><section class=\"sg-cgv__section\"><h2>2. Products<\/h2><p>The shop offers, among other items, player cards and courses for the golf simulation game. The essential characteristics, set contents and format are described on each product page. The products sold are standard physical products, even when printed after an order is placed; they are neither downloads nor personalised creations. Customers must check the stated version and compatibility before ordering. If a product becomes unavailable after an order has been placed, ARNOLI will inform the customer and refund, without undue delay, the amounts paid for products that cannot be supplied; no substitution will be imposed.<\/p><\/section><section class=\"sg-cgv__section\"><h2>3. Prices and delivery charges<\/h2><p>Prices are stated in euros and include all applicable taxes. The amount payable, applicable taxes and delivery charges are shown to the customer before the order is confirmed, according to the delivery address. No additional charge will be added after confirmation without the customer\u2019s agreement. The applicable price is the price confirmed when the order is placed.<\/p><p>Metropolitan France: Mondial Relay, \u20ac5.90; free for product orders of \u20ac59 or more after discounts, excluding delivery charges. Colissimo home delivery, \u20ac8.90, with no free-delivery offer.<\/p><p>Other European countries available for ordering: Mondial Relay, \u20ac10.90 where available; free for product orders of \u20ac119 or more after discounts, excluding delivery charges. Colissimo International, \u20ac19.90, with no free-delivery offer. The delivery method offered depends on the destination and service coverage.<\/p><\/section><section class=\"sg-cgv__section\"><h2>4. Orders and payment<\/h2><p>The customer selects the products, checks the basket, enters their contact details and address, selects a delivery method and payment method, then checks and, if necessary, corrects the order summary. The customer reads these General Terms and Conditions of Sale and confirms the order with an obligation to pay. The confirmation and order summary are sent by email; a copy of the applicable General Terms and Conditions of Sale must be provided on a durable medium.<\/p><p>Payment is due in full when the order is placed, by bank card through Stripe or through PayPal. Any offers made to the customer within their PayPal account are governed by their relationship with that provider. If payment fails, the order will not be dispatched. Payment and order references allow the transaction to be tracked.<\/p><\/section><section class=\"sg-cgv__section\"><h2>5. Delivery areas and times<\/h2><p>Parcels are dispatched from metropolitan France. The intended delivery destinations are metropolitan France, including Corsica, and Germany, Belgium, Spain, Italy, Luxembourg, the Netherlands and Portugal, subject to the areas actually served and offered before order confirmation. Delivery to French overseas territories is not available at launch.<\/p><p>Orders are scheduled to be prepared and dispatched within 24 working hours of payment confirmation. The maximum delivery time, including preparation, is 7 working days within metropolitan France and 15 working days for the other destinations offered. For these commitments, working days are Monday to Friday, excluding public holidays in France and at the destination. Any specific delivery times are stated before the order is placed.<\/p><p>Average delivery estimates provided by the carrier do not replace these commitments. A tracking link is provided where available. For collection-point delivery, the customer is informed when the parcel is available and of the collection deadline. If the parcel is not collected, the customer must contact ARNOLI to arrange the next steps; failure to collect a parcel does not in itself constitute notice of withdrawal and does not automatically result in the loss of amounts paid.<\/p><\/section><section class=\"sg-cgv__section\"><h2>6. Delay, loss or damage<\/h2><p>In the event of a delay or problem, the customer should contact ARNOLI at contact@simugolf.fr, quoting their order reference. ARNOLI remains the customer\u2019s point of contact for proper fulfilment of the delivery and will liaise with the carrier.<\/p><p>If the agreed delivery deadline is not met, the customer may request delivery within an additional reasonable period, then terminate the contract if ARNOLI fails to deliver within that period. The contract may be terminated immediately in the circumstances provided for by law, particularly where the seller refuses to deliver or where an agreed delivery date was an essential condition of the contract. Amounts due will be refunded within fourteen days of termination.<\/p><p>The risk of loss or damage passes to the customer when the customer, or a third party designated by the customer other than the proposed carrier, takes physical possession of the goods. Customers are advised to report visible damage upon receipt, although failure to record reservations does not remove their statutory guarantee rights.<\/p><\/section><section class=\"sg-cgv__section\"><h2>7. Right of withdrawal<\/h2><p>The consumer may give notice of withdrawal without providing a reason within fourteen days of receiving the goods, either personally or through a designated third party other than the carrier. Where several goods from the same order are delivered separately, the period begins upon receipt of the last item. The day of receipt is not counted; statutory rules extending the deadline apply.<\/p><p>Notice of withdrawal may be given by an unequivocal statement sent to contact@simugolf.fr or by post to ARNOLI, 7 rue Condorcet, 91350 Grigny, France. The form below may be used, but is not compulsory. Prior return authorisation is not required.<\/p><p>You may also use our <a href=\"\/en\/mon-compte\/withdraw-order\/\">online withdrawal form<\/a>which is accessible without logging in. Check the information and then confirm your withdrawal. An acknowledgement of receipt stating the date and time of your request will be sent to you by email.<\/p><p>Products must be returned to ARNOLI at the above address without undue delay and no later than fourteen days after notice of withdrawal. The direct cost of returning products following withdrawal is borne by the customer. This provision does not apply to costs incurred in exercising statutory guarantee rights or returning a product sent in error.<\/p><p>The customer must use suitable packaging and retain proof of dispatch. A refund is not conditional upon the original packaging being intact. The customer may be held liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.<\/p><\/section><section class=\"sg-cgv__section\"><h2>8. Refunds following withdrawal<\/h2><p>Where withdrawal covers the entire order, ARNOLI will refund the amounts paid, including the original delivery charges corresponding to the least expensive standard delivery method offered. Any additional charge resulting from the choice of a more expensive delivery method will not be refunded.<\/p><p>The refund will be made without undue delay and no later than fourteen days after notice of withdrawal. ARNOLI may withhold the refund until the goods have been received back or proof of their dispatch has been provided, whichever occurs first. The same payment method will be used unless the customer expressly agrees to another method that incurs no fees for them. No credit note will be imposed.<\/p><\/section><section class=\"sg-cgv__section\"><h2>9. Statutory guarantees<\/h2><p>ARNOLI is liable under the statutory guarantee of conformity and the statutory guarantee against hidden defects. Claims should be sent to contact@simugolf.fr or to the registered office address, together with information identifying the purchase and the problem.<\/p><div class=\"sg-cgv__garanties\" style=\"border:2px solid #073c31;padding:24px;margin-top:24px;background:#fff\"><h3>Statutory guarantees notice<\/h3><p>The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity becomes apparent. During this period, the consumer is required to establish only the existence of the lack of conformity, rather than the date on which it became apparent.<\/p><p>Where the sales contract provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory guarantee applies to that digital content or digital service throughout the agreed supply period. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or digital service, rather than the date on which it became apparent.<\/p><p>The statutory guarantee of conformity requires the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.<\/p><p>The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without significant inconvenience.<\/p><p>The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without significant inconvenience.<\/p><p>If the consumer requests repair of the goods but the seller requires replacement instead, the statutory guarantee of conformity is renewed for a period of two years from the date the goods are replaced.<\/p><p>The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund upon returning the goods, if:<\/p><p>1\u00b0The trader refuses to repair or replace the goods;<\/p><p>2\u00b0The goods are repaired or replaced after a period of thirty days;<\/p><p>3\u00b0Repair or replacement causes significant inconvenience to the consumer, particularly where the consumer ultimately bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;<\/p><p>4\u00b0The lack of conformity persists despite the seller\u2019s unsuccessful attempt to bring the goods into conformity.<\/p><p>The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is sufficiently serious to justify an immediate price reduction or termination. In such cases, the consumer is not required to request repair or replacement beforehand.<\/p><p>The consumer is not entitled to terminate the sale if the lack of conformity is minor.<\/p><p>Any period during which the goods are unavailable for use while being repaired or replaced suspends the remaining guarantee period until the goods are delivered back in working order.<\/p><p>The rights mentioned above arise from Articles L. 217-1 to L. 217-32 of the French Consumer Code.<\/p><p>A seller who, in bad faith, obstructs the exercise of the statutory guarantee of conformity may incur a civil fine of up to \u20ac300,000, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).<\/p><p>The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or a full refund upon returning the goods.<\/p><\/div><\/section><section class=\"sg-cgv__section\"><h2>10. Complaints and mediation<\/h2><p>For any complaint, the customer may write to contact@simugolf.fr or to ARNOLI, 7 rue Condorcet, 91350 Grigny, France.<\/p><p>If a prior written complaint to ARNOLI has not led to a satisfactory resolution, the consumer may refer the dispute to a consumer mediator free of charge, under the conditions provided for by law.<\/p><\/section><section class=\"sg-cgv__section\"><h2>11. Personal data and intellectual property<\/h2><p>The data required for the order is used for payment, delivery, customer service and legal obligations, under the conditions described in the website\u2019s privacy policy. <a href=\"\/en\/politique-de-confidentialite\/\">politique de confidentialit\u00e9<\/a> du site.<\/p><p>Purchasing a product does not transfer any rights to reproduce or commercially exploit the cards, rules, visuals or other protected elements. This choice does not deprive a consumer residing in another country of the mandatory protective provisions available to them under the applicable rules of private international law.
